That would mean that, as a moderated forum, he has done due diligence to stop things that are clearly difamatory concerning him. And , further more, anyone in the past or future who felt like he had not used this judgement concerning them would buttress their cause of action. Most case law (common law) quoted on this site is out of date. There are numerous findings and cases in federal court now that do not boad well for people who attempt to ignore basic tenets of media law.
I will send you my bill.

And when you do, please tell us why you’re citing common law rather than civil law.

So if you’re talking defamation, and we’re all in La., how we gonna get to federal court? And why won’t they apply state law?

Because federal law will prevail, this is a common carrier issue along with a constitu. issue...It wont be tried in the 19th in La. ..it will go to federal court, from there to the 5th circ.....no doubt there will be an appeal.

[QUOTE=Morning Breath]Just as an aside to our legal advisors: if both the plaintiff and defendant in a defamation suit live in Louisiana, the case cannot be filed in federal court, nor can a state court suit be removed by the defendant to federal court. There is no diversity of citizenship.
The relatively smarter of two Unregistereds was saying something like that around 5:12 pm yesterday, having been maligned as a “Dumbass.” He or she didn’t go into this, but has heard that somewhere around something called 15 U.S.C. § 1681 et seq there is a Fair Credit Reporting Act, and depending on how the original poster got the supposed credit info about Charlie, THAT might have a way into Federal Court. I don’t think he or she felt like reading the act though, which sounded way too much like work. Charlie can read it if he needs to.
